When the QUBE icon appears on your Cinemax or HBO television channel or in other media, you scan the icon using the QUBE application. You will then be redirected to a separate site or service, where you may be able to access benefits, special offers, from third-party advertisers and/or business partners, or even HBO (hereinafter, the “Benefits”). The Benefits may include discounts and promotions for products and/or services from third party advertisers and or business partners, and/or special Cinemax and/or HBO content. This Privacy Policy explains our information practices and the choices you can make about information collected through our QUBE application. It applies to all features present in QUBE, and it is designed to provide transparency into our privacy practices and principles. This information may include different categories of personal data, such as user data, usage data and technical data. Below we describe the types of personal data we may collect: Registration, account and sign-up data. We may collect personal data in the course of your use of, or registration with, QUBE. For example, when you choose to register for QUBE and create an account, you may provide us with certain personal data. This type of personal data may include: name, date of birth, gender, country, state and city, and e-mail address. You may attach a picture to your profile, however please note that we do not store this picture; is stored solely on the memory of your device. Location data. We may have access to and/or collect certain data about your location, such as your country, state and city, when you provide it or via device information (such as, for example, an IP address). Camera access. To function, QUBE requires access to your device’s camera. Information gathered from scanning technology is used to make the services and features available to you, and will also be used as further provided in this Privacy Policy. We will not retain photograph of what you scan, however we will retain data associated with the scan as otherwise provided herein. Access to Other Device Applications and Functionalities. QUBE may utilize other applications and/or functionalities of your device, in response to an action taken from you, to enable and/or enhance your QUBE experience. For example, QUBE may utilize your device’s browser to connect you to a site related to a product or offering you have scanned, or it may also use your device’s telephone functionality, if you scan or select a prompt such as “Call Now” or “Contact us Now”. QUBE will not use any functionalities or applications within your phone, without you first initiating an action requiring use of any such functionality or application. Technical and usage data. We also collect certain technical and usage data when you use QUBE, such as the type of device (brand, manufacturer and model) and operating system (name, version and platform) you are using, your mobile carrier, unique device identifier, preferred language, IP address, device settings, and certain usage information (including but not limited to, for example, information about the date and time of scan, the products scanned, etc.). How we use personal data We use personal data for the purposes described in this policy, or for the purposes disclosed at the time of collection, or otherwise with your consent. Providing services. We use personal data we collect about you through QUBE to fulfill your requests for, and otherwise provide or analyze your use of our services, and to provide, develop, maintain, personalize, protect, and improve your experience. For example, we use personal data collected on QUBE to enable you to engage with interactive features of advertising campaigns, and to locate and access personalized information or functionality based on your location. Communicating with you and others. We may use personal data to communicate with you for things like, for example: (i) notifying you when we make changes to our policies and agreements, (ii) responding to your inquiries, (iii) contacting you about your account, or (iv) sending you information about promotions and offers from QUBE, and other HBO Group entities. . Use of technical and usage data. In addition to any personal data or other information that you choose to submit to QUBE, HBO, the HBO LAG Companies, our affiliates, and our third party service providers may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with QUBE ("Usage Information"), to improve design, functionality and content of QUBE and to enable us to personalize your experience with QUBE. Some of these technologies may be downloaded to your device and may set or modify settings on your device. This Usage Information may include the software that you are using, the URL (Uniform Resource Locator) that referred you to the QUBE application, all the areas within QUBE that you visit and your activities there (e.g. what markers you scan, etc.), your Location Data, your device characteristics and certain device data, and the time in which you used the QUBE application, among other information. We may use this type of information (i) to provide, develop, maintain, personalize, protect, and improve QUBE, (ii) to perform analytics, including to analyze and report on usage and performance of QUBE, (iii) to protect against, identify, and prevent fraud and other unlawful activity, (iv) to create aggregate data about groups or categories of our users, and (v) for us and our affiliates, business partners, and select third parties to target, offer, market, or advertise products, programs, or services. Compliance. We may use personal data we collect to detect, investigate, and prevent activities on QUBE that may violate our terms of use, could be fraudulent, violate copyright, or other rules, to comply with legal requirements, and to protect our rights and the rights and safety of our users and others. Cookies and other tracking technologies When you use QUBE or utilize the Services, we may also use cookies or similar technologies on your devices to collect, store, and communicate information about you or the activity on devices associated with you as you use QUBE. By using QUBE, you acknowledge our collection and use of your information from activity on devices associated with your account in accordance with this Privacy Policy. We may work with third parties to present advertisements, and in data collection, reporting, ad delivery and response measurement, and site analytics on QUBE and/or the Services.
